2. What are the grounds for divorce in the UK?
In England and Wales there is only one ground for divorce – that your marriage has irretrievably broken down.
3. Do I need a solicitor for a divorce?
No, not if both parties are in agreement over all matters which can therefore be settled out of court. When more complex matters arise, particularly when there isn’t mutual agreement between parties, a divorce solicitor can streamline the process, providing advice and negotiating on your behalf to ensure a favourable outcome for you, while ensuring legal requirements are met.
4. Do I need a financial settlement agreement?
Yes, a divorce ends the marriage but does not deal with financial responsibilities; a financial settlement aims to achieve a fair division of finances, assets and responsibilities between parties involved in a divorce or separation.
5. How are child arrangements determined in a divorce?
Parents are encouraged to mutually decided upon arrangements for any children without court involvement, however if this isn’t possible, a court can issue a Child Arrangement Order which are based on the child’s best interests.
